traqr — South Africa peer-to-peer deals, escrow, disputes, and refunds
Agreement
These Terms & Conditions (“Terms”) govern your use of traqr (“traqr”, “we”, “us”) and the traqr mobile application and related services in South Africa. By creating an account or using traqr, you agree to these Terms and our Privacy Policy.
traqr provides a technology platform that helps buyers and sellers arrange deals, messaging, escrow-style payment flows, and logistics choices. traqr is not the seller of goods or services in your deals unless we say so in writing. The contract for the item is between you and the other party.
Accounts & eligibility
You must provide accurate information, keep your login and device secure, and be legally able to enter contracts in South Africa. traqr is offered for users in South Africa; account verification may use SMS and other checks we describe in the app.
We may suspend or terminate accounts that abuse the service, commit fraud, harass others, or break these Terms.
Deals, escrow & fees
When you fund a deal, funds are held according to the in-app flow until delivery is confirmed or another outcome applies (such as a refund or dispute resolution). Fees (for example, a seller fee on payout) are shown in the app and may change with notice where the law allows.
Shipping: shipping is arranged between parties using options in the app (for example, weight or volume-based quotes and a buyer-chosen partner where available). Unless a deal states otherwise, the buyer funds shipping at the time escrow is funded. Pickup and inspection may use images or other evidence as described in the app.
Refunds — what they cover
A refund returns money that was held for a deal (or part of it) to the right party when the deal does not complete as agreed or when the app’s rules allow cancellation.
Item vs shipping: Where a refund is due, we aim to treat item price and shipping clearly: if only the item failed or was returned, shipping may be refunded, partially refunded, or not refunded depending on what was paid, what carriers charged, and whether collection or return was used. The app will show the breakdown when you request or receive a refund.
Timing: approved refunds are sent to the original payment path or nominated account where supported. Bank processing times are outside our control.
No double recovery: you cannot keep the item and also receive a full item refund unless the deal rules allow it after a return is completed.
Refunding — when it happens
Examples of situations that may lead to full or partial refunding (subject to evidence and review) include:
- The seller does not ship within the agreed window and cannot justify the delay.
- The item is materially not as described and you follow the return or evidence steps in the app.
- The deal is cancelled before shipment in line with the cancellation rules shown for that deal.
- A technical or fraud check requires reversing a pending capture that never completed.
Examples where a refund may be denied or reduced include: buyer changed mind after shipment where the deal does not allow cooling-off; item damage after confirmed delivery; missing proof when required; or attempts to abuse chargebacks.
Disputes — how they work
If you and the other party disagree, open a dispute in the app as soon as you can. Provide photos, tracking, messages, and any pickup or handover notes requested.
Before shipment: disputes usually focus on payment, deal terms, or cancellation. Funds may stay on hold until the dispute is resolved or timed rules apply.
On or after delivery: disputes may cover condition, completeness, or “not as described” claims. You may need to cooperate with return shipping; who pays return shipping depends on the deal type and outcome (for example, seller fault vs buyer remorse).
traqr may use automated checks, timelines, and (where applicable) manual review. Our decisions aim to follow these Terms and the in-app dispute flow. You agree to cooperate with reasonable information requests.
Chargebacks & banks
If you initiate a bank or card chargeback while a dispute is open, we may share records with processors to show delivery, tracking, or your acceptance in the app. Abuse of chargebacks can lead to account closure.
Liability & disclaimer
To the fullest extent permitted by South African law, traqr is not liable for indirect or consequential loss, or for events caused by carriers, banks, or other users. Our total liability for a claim relating to the service is limited to the fees you paid to traqr for that deal in the twelve months before the claim, except where the law does not allow such a cap.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot legally be excluded.
Changes & law
We may update these Terms; we will give notice in the app or by email where required. Continued use after the effective date can mean acceptance.
These Terms are governed by the laws of the Republic of South Africa. Courts in South Africa have non-exclusive jurisdiction unless mandatory consumer rules say otherwise.
